{"id":11121,"date":"2019-10-28T09:47:10","date_gmt":"2019-10-28T08:47:10","guid":{"rendered":"https:\/\/saludporderecho.org\/?p=11121"},"modified":"2019-10-28T09:47:27","modified_gmt":"2019-10-28T08:47:27","slug":"novartis-goes-to-court-to-try-to-prevent-the-government-from-making-information-public-about-the-approval-of-one-of-its-most-innovative-treatments","status":"publish","type":"post","link":"https:\/\/saludporderecho.org\/en\/novartis-goes-to-court-to-try-to-prevent-the-government-from-making-information-public-about-the-approval-of-one-of-its-most-innovative-treatments\/","title":{"rendered":"Novartis goes to court to try to prevent the government from making information public about the approval of one of its most innovative treatments"},"content":{"rendered":"\n<ul class=\"wp-block-list\"><li>A few months ago, Spain\u2019s Consejo de la Transparencia (Transparency Council) ruled in favour of the No es Sano (\u201cIt&#8217;s Not Healthy\u201d) campaign when the latter requested information about the criteria under which Kymriah had been approved in Spain.<\/li><li>The pharmaceutical company took the case to court in order to paralyse the process and prevent the government department from sharing this information and, therefore, from making it known to the public.<\/li><li>The organisations Salud por Derecho (\u201cHealth by Right\u201d) and the OCU (Spain&#8217;s consumers and users association) appeared on behalf of the No es Sano campaign during the contentious process launched by Novartis in its appeal against the Transparency Council&#8217;s ruling.<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">At\nthe end of 2018, the government announced its approval of Kymriah &#8211; an\ninnovative therapeutic procedure that falls within the so-called cellular\nimmunotherapies (CART) and which take advantage of our immune system&#8217;s ability\nto recognise and attack tumours. Kymriah is the first therapy of its kind to be\napproved in Spain and is aimed at treating acute lymphoblastic leukaemia (ALL)\n&#8211; a type of bone marrow and blood cancer that particularly affects children and\nyoung people under 25.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">After\nit was approved, <strong><a href=\"http:\/\/www.noessano.org\">No es Sano<\/a><\/strong> &#8211; a campaign promoted by\nSalud Por Derecho &#8211; made a request to the Department of Health via the\nTransparency Council\u2019s website that it be informed of its price and the therapeutic\nand financial criteria used to justify its approval. In January 2019, the\ngovernment sent a letter to the campaign setting out the cost for financing of\nthe treatment, which in Spain amounts to 320,000 euros. However, it provided\nonly generic and incomplete information about its criteria, and failed to\nanswer No es Sano&#8217;s request. The campaign therefore turned to Spain&#8217;s General\nTransparency Council (Consejo General de la Transparencia) &#8211; an independent\nbody responsible for ensuring the transparency of public activity &#8211; and it\nruled in its favour, calling on the government to make this information\navailable.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At\nthis point, Novartis decided to take the case to court with the aim of halting\nthe process and to try to prevent the campaign (and, therefore, the public)\nfrom having access to this information. The company has filed a contentious\nappeal against the Transparency Council&#8217;s ruling and No es Sano will take part\nin the proceedings, represented by two of its organisations: Salud por Derecho\nand OCU.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8220;The\nTransparency Council&#8217;s resolution considers that this information should be\nmade available because it is in the public interest &#8211; something for which we at\nSalud por Derecho and the No es Sano campaign have been fighting for years; and\nwhich is supported by international organisations including the World Health\nOrganisation. However, with this move, Novartis is attempting to ensure its\nsupposed commercial interests prevail over those of the public. It is for this\nreason that we are taking part in this process&#8221;, says Vanessa L\u00f3pez, Salud\npor Derecho director.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ileana\nIzverniceanu, OCU&#8217;s director of communications and institutional relations,\nsays that &#8220;it is essential that we know which data the Department is using\nto establish financing and pricing for new innovative therapies &#8211; in particular\nwhen we know about estimates that have significantly lower development costs.\nAccording to Izverniceanu, &#8220;These medicines are financed through taxation\nand every extra euro we pay to pharmaceutical laboratories is one less euro\nthat could be invested in other national health system requirements.
