{"id":11988,"date":"2020-10-15T12:07:45","date_gmt":"2020-10-15T10:07:45","guid":{"rendered":"https:\/\/saludporderecho.org\/?p=11988"},"modified":"2020-10-16T11:38:07","modified_gmt":"2020-10-16T09:38:07","slug":"379-international-organizations-ask-governments-to-limit-patents-on-vaccines-and-drugs-for-covid-19","status":"publish","type":"post","link":"https:\/\/saludporderecho.org\/en\/379-international-organizations-ask-governments-to-limit-patents-on-vaccines-and-drugs-for-covid-19\/","title":{"rendered":"379 international organizations ask governments to limit patents on vaccines and drugs for COVID-19"},"content":{"rendered":"<p><em><strong>Salud por Derecho has signed <a href=\"https:\/\/saludporderecho.org\/wp-content\/uploads\/2020\/10\/CSOLetter_SupportingWaiverFinal1.pdf\"><span style=\"color: #ff9900;\">this letter<\/span><\/a> and asks the Government of Spain to support the initiative and to put in place all the legal mechanisms needed to make it effective.<\/strong><\/em><\/p>\n<p>&nbsp;<\/p>\n<p>Dear Members of the World Trade Organization,<\/p>\n<p>We the undersigned organisations call on all WTO Members to strongly support the adoption of the<br \/>\ndecision text proposed by India and South Africa in their proposal for \u201cWaiver from certain provisions<br \/>\nof the TRIPS Agreement for the prevention, containment and treatment of COVID19\u201d (Waiver<br \/>\nProposal).<\/p>\n<p>When COVID-19 was declared to be a pandemic, there was overwhelming consensus that to curb the<br \/>\nspread of COVID-19, there was an urgent need for international collaboration to speed up product<br \/>\ndevelopment, scale up of manufacturing, expand the supply of effective medical technologies and<br \/>\nensure everyone, everywhere is protected. There were even calls including from several Heads of State<br \/>\nfor COVID-19 medical products to be treated as global public goods.<\/p>\n<p>Seven months into the pandemic, there is no meaningful global policy solution to ensure access. Instead,<br \/>\nthere is an inequality of access to critical technologies that are needed to address the pandemic. Many<br \/>\ncountries, especially developing and least developed countries struggling to contain COVID-19 have<br \/>\nexperienced and are facing acute shortages of medical products, including access to diagnostic testing.1<br \/>\nFurthermore, wealthy nations representing only 13 percent of the global population have locked up at<br \/>\nleast half the doses of the world\u2019s five leading potential vaccines.<\/p>\n<p>In this pandemic, the pharmaceutical industry has mainly pursued \u201cbusiness as usual\u201d approaches,<br \/>\nentrenching monopolistic intellectual property (IP) controls over COVID-19 health technologies that<br \/>\nrestrict scale-up of manufacturing, lock out diversified suppliers, and undermine competition that<br \/>\nresults in lower prices. A few companies, such as Astra Zeneca, have pledged not for profit prices during<br \/>\nthe pandemic, and yet by maintaining control over these technologies, can unilaterally declare the end<br \/>\nof the pandemic and increase prices to maximise profits, even if it undermines international efforts to<br \/>\nsave lives.<\/p>\n<p>The COVID-19 Technology Access Pool (C-TAP) launched by WHO (to voluntarily share knowledge,<br \/>\nIP and data), has been rejected by the pharmaceutical industry.4 Instead, companies continue to sign<br \/>\nsecretive and restrictive licensing agreements. For example, Gilead Sciences\u2019 secret licensing<br \/>\nagreements for remdesivir, a medicine that was developed with substantial public funding, are restricted<br \/>\nto a few manufacturers of its choosing, thereby preventing low-cost supply to nearly half of the world\u2019s<br \/>\npopulation. Unsurprisingly, there have been global shortages of the medicine, with many developing<br \/>\ncountries yet to see even a single vial of the treatment exported to them. Given the medicine\u2019s limited<br \/>\neffectiveness, we are deeply concerned that such an approach for a safe and effective therapy will<br \/>\nexclude even more people from treatment access.<\/p>\n<p>Additionally, emerging intellectual property infringement disputes on COVID-19 technologies<br \/>\nthreatens to block collaborative research and development and manufacturing of COVID-19 medical<br \/>\nproducts.<\/p>\n<p>These restrictive business strategies have directly translated into exorbitant pricing and profiteering,6<br \/>\nWith entire health systems already overwhelmed by COVID-19 and with governments facing a looming<br \/>\neconomic crisis, the health budgets of many countries simply cannot sustain highly priced COVID-19<br \/>\nmedical products. These realities will also hinder production by any competent manufacturer and<br \/>\nimpede the full freedom to collaborate, in developing, producing, importing and exporting the needed<br \/>\nmedical products.<\/p>\n<p>While the TRIPS Agreement contains flexibilities that can promote access, many WTO Members may<br \/>\nface challenges in using them promptly and effectively. For instance, compulsory license offers a<br \/>\n\u201cproduct by product\u201d, and \u201ccountry by country\u201d approach with variations in national laws, whereas the<br \/>\npandemic requires collective global action to tackle IP barriers and facilitate technology transfer. Where<br \/>\nthe IP barrier is beyond patents, national laws may not provide for sufficient flexibilities. Further,<br \/>\nArticle 31bis, a mechanism to supply countries with insufficient manufacturing capacity, does not<br \/>\nprovide an expedited solution and many countries have also opted out of using the mechanism.<br \/>\nUnless concrete steps are taken at the global level to address intellectual property and technology<br \/>\nbarriers, the abovementioned failures and shortcomings will replay as new medicines, vaccines and<br \/>\nother medical products are rolled out. Access will have to be rationed, with devastating effects for public<br \/>\nhealth and global economic recovery.<\/p>\n<p>In a global pandemic where every country is affected, we need a global solution.7 Adoption of a<br \/>\nWaiver at the WTO level will suspend implementation, application and enforcement of the relevant<br \/>\nprovisions of the TRIPS Agreement in relation to prevention, containment, and treatment of COVID-<br \/>\n19. It enables an expedited, open and automatic global solution to allow uninterrupted collaboration in<br \/>\ndevelopment, production and supply, and to collectively address the global challenge facing all<br \/>\ncountries. It\u2019s time for governments to take collective responsibility and put people\u2019s lives before<br \/>\ncorporate monopolies.<\/p>\n<p>Therefore, we strongly request you to unequivocally support the adoption of the proposed Waiver<br \/>\nat the upcoming TRIPS Council meeting.<\/p>\n<p><strong>SIGNATORIES<\/strong><\/p>\n<p><strong>Global<\/strong><\/p>\n<p>1.
